These Website Terms and Conditions (“Terms”) govern your access to and use of the website located at https://trugenex.org/, including its pages, articles, provider profiles, forms, graphics, videos, and other content or functionality collectively referred to as the “Site.”
The Site is operated by Personalized Life Style Nutrition DBA, doing business as Trugenex (“Trugenex,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. Please do not use the Site if you do not agree to them.
1. About Trugenex and the Site
Trugenex provides information concerning nutrition, wellness, lifestyle education, coaching, and related services.
The Site allows visitors to:
* Learn about Trugenex and its providers;
* Review general nutrition and wellness information;
* Learn about available services;
* Select a provider and submit a general inquiry; and
* Obtain the telephone number for Trugenex.
The public Site is informational. Unless expressly stated otherwise, it does not process payments, create appointments, establish user accounts, receive uploaded records, or provide a secure client portal.
For purposes of these Terms, the word “provider” refers to a person identified on the Site as providing nutrition, wellness, coaching, education, aesthetic, or related services. Use of the word “provider” does not by itself mean that the person is a physician or another licensed medical professional.
2. Nutrition and wellness information only
Trugenex is a nutrition and wellness business and is not a medical practice.
The Site and Trugenex’s general nutrition and wellness services do not provide:
* Medical diagnosis;
* Medical treatment;
* Emergency care;
* Medical procedures;
* Prescription medication;
* Medication management;
* Mental-health treatment;
* Medical testing;
* Medical-record review; or
* Any service that Trugenex or the applicable provider is not qualified or legally authorized to perform.
Information on the public Site is provided for general educational and informational purposes. It is not individualized medical advice and is not a substitute for examination, diagnosis, treatment, or advice from a physician, registered dietitian, pharmacist, mental-health professional, or other appropriately qualified professional.
Do not use information from the Site as the sole basis for starting, stopping, or changing:
* A prescription or over-the-counter medication;
* A dietary supplement;
* A medically prescribed diet;
* Treatment for a health condition;
* An exercise program; or
* Another practice that could materially affect your health.
Consult an appropriately qualified professional before making significant nutrition, supplement, exercise, or lifestyle changes, particularly when you:
* Have a diagnosed medical condition;
* Take prescription medication;
* Have food allergies or intolerances;
* Are pregnant or nursing;
* Have a history of disordered eating;
* Are seeking services for a minor; or
* Have symptoms requiring medical evaluation.
Nothing on the Site represents that Trugenex can diagnose, treat, cure, or prevent a disease.
3. Not an emergency or urgent-care service
The Site, contact form, telephone number, and voicemail are not emergency or urgent-care services and are not monitored continuously.
Do not use the Site or leave a voicemail to request emergency assistance or immediate medical advice. Call 911 or the appropriate emergency service when you believe that you or another person is experiencing an emergency.
For a nonemergency health concern requiring prompt attention, contact an appropriately licensed healthcare professional.
4. No automatic client relationship
Accessing the Site, reading its content, selecting a provider, submitting a form, calling Trugenex, leaving a voicemail, or receiving a general response does not automatically create a client relationship.
A client relationship begins only after:
1. Trugenex or the applicable provider agrees to accept the engagement;
2. Any required intake information has been completed;
3. The nature and scope of the service have been agreed upon; and
4. Any applicable service agreement, consent, or payment requirement has been completed.
Trugenex is not required to accept any person as a client or provide any particular service.
Submitting an inquiry does not guarantee:
* That the selected provider is available;
* That the selected provider will personally review the inquiry;
* That Trugenex will provide the service requested;
* That the service is appropriate for the person making the inquiry; or
* That a response will be provided within a particular period.
5. Provider credentials and service descriptions
Trugenex seeks to describe each provider’s education, training, certifications, experience, and services accurately.
Provider credentials and scopes of service may differ. You are responsible for reviewing the applicable provider’s stated credentials and asking questions when a particular license, certification, or qualification is important to you.
A provider listing does not represent that the provider:
* Is a physician;
* Is a registered or licensed dietitian;
* Holds a medical license;
* Can diagnose or treat disease;
* Can prescribe medication;
* Can provide every service described elsewhere on the Site; or
* Is authorized to provide services in every location.
Only credentials specifically stated on the provider’s profile should be attributed to that provider.
Trugenex may update provider listings, availability, credentials, and service descriptions as information changes.
6. Contact-form submissions
The Site’s contact form is intended for brief, general inquiries.
The form may request:
* Your name;
* Your email address;
* The provider you wish to contact; and
* A brief description of what you would like to discuss.
By submitting the form, you:
1. Confirm that the information you provide is accurate to the best of your knowledge;
2. Confirm that you are authorized to provide that information;
3. Request that Trugenex route the inquiry to the selected provider or appropriate team member;
4. Authorize Trugenex or the selected provider to respond using the email address you provide; and
5. Acknowledge that ordinary email may not be appropriate for sensitive or confidential information.
You do not consent to recurring advertising or promotional email merely by submitting a general inquiry.
Information that should not be submitted
Do not use the public form to send:
* Medical records;
* Laboratory or genetic-test results;
* Medical images;
* Detailed medication histories;
* Insurance information;
* Social Security numbers;
* Government identification numbers;
* Credit-card or bank information;
* Passwords or account credentials;
* Information protected by another person’s privacy rights;
* Detailed information about a medical emergency; or
* Other information that is unnecessary for a general inquiry.
If more detailed information is needed after an initial response, Trugenex or the selected provider may provide appropriate instructions.
Trugenex may delete or decline to respond to a message that is unlawful, threatening, abusive, fraudulent, misleading, excessively sensitive, unrelated to Trugenex’s services, or reasonably believed to be spam.
7. Telephone calls and voicemail
The published telephone number is intended for general business and service inquiries.
When calling or leaving a voicemail:
* Do not provide unnecessary sensitive information;
* Do not leave medical records or detailed medical histories;
* Do not provide payment-card, banking, Social Security, or password information; and
* Do not use voicemail for emergency or urgent health matters.
Trugenex does not guarantee that a call or voicemail will be answered or returned within a particular period.
8. Separate terms for paid services
A consultation, coaching engagement, nutrition service, wellness program, or other paid service may be governed by a separate written agreement, intake document, cancellation policy, consent, or financial policy.
Those separate documents apply to the particular service. These Terms govern use of the public Site.
When a service-specific agreement directly conflicts with these Terms, the service-specific agreement controls with respect to that service.
9. Personal responsibility
Nutrition, supplement, exercise, skincare, and lifestyle decisions can affect people differently.
You are responsible for:
* Providing accurate information during any service engagement;
* Asking questions when instructions are unclear;
* Deciding whether to follow a general recommendation;
* Obtaining appropriate professional advice when needed;
* Monitoring your own response to lifestyle changes; and
* Seeking medical attention for symptoms or conditions that require it.
Trugenex does not guarantee that a recommendation appropriate for one individual will be appropriate for another.
10. Results and testimonials
Individual experiences and results vary.
Testimonials, reviews, examples, case descriptions, before-and-after materials, and provider statements may describe the experience of a particular person. They do not guarantee that another person will obtain the same or similar result.
Outcomes may depend on factors including:
* The individual’s circumstances;
* Consistency and participation;
* Diet and lifestyle;
* Age;
* Existing health conditions;
* Medications;
* Genetics;
* Environment;
* The nature and duration of the service; and
* Other factors outside Trugenex’s control.
No result, improvement, amount of weight change, timeframe, symptom change, or other outcome is promised unless it is expressly stated in a separate written agreement signed by Trugenex.
11. Third-party products and services
The Site may mention or link to third-party:
* Products;
* Supplements;
* Educational resources;
* Professional services;
* Social-media platforms;
* Videos;
* Scheduling services;
* Maps; or
* Other websites.
Trugenex does not control independently operated third parties and is not responsible for their content, availability, security, privacy practices, terms, products, services, statements, or conduct.
A link or reference does not necessarily constitute an endorsement or guarantee.
You are responsible for reviewing the terms, privacy policy, instructions, warnings, ingredients, and other information provided by the third party before using a third-party product or service.
Any material affiliate, referral, sponsorship, or other financial relationship should be disclosed where the applicable recommendation appears.
12. Ownership and intellectual property
Unless otherwise stated, the Site and its content are owned by or licensed to Trugenex and are protected by applicable copyright, trademark, and other intellectual-property laws.
Protected content may include:
* The Trugenex name and branding;
* Logos;
* Page designs;
* Written copy;
* Articles;
* Graphics;
* Photographs;
* Videos;
* Downloads;
* Service descriptions; and
* Other original materials.
Trugenex grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your personal and lawful noncommercial use.
You may not, without written authorization:
* Reproduce or republish substantial Site content;
* Sell, license, or commercially exploit Site content;
* Remove copyright, trademark, or attribution notices;
* Use Trugenex branding in a manner that suggests an unauthorized affiliation;
* Copy the Site’s design or content for a competing business;
* Systematically scrape, harvest, or extract Site information;
* Use Site content to create misleading health or wellness claims; or
* Modify and redistribute Site content in a manner that changes its meaning.
Third-party names, trademarks, photographs, videos, and other content remain the property of their respective owners.
13. Information you submit
You retain any ownership rights you may have in original content you submit through the Site.
You give Trugenex a limited right to receive, store, copy, route, and use your submission only as reasonably necessary to:
* Respond to the inquiry;
* Send it to the provider you selected;
* Administer a requested service;
* Maintain appropriate business records;
* Protect the Site and its users; and
* Comply with legal obligations.
Submitting a message does not give Trugenex permission to publish it as a testimonial or use your name, likeness, or story in advertising. Separate permission would be required for that use.
You represent that you have the right to submit the information you provide and that your submission does not unlawfully violate another person’s rights.
14. Prohibited conduct
You may not:
1. Use the Site for an unlawful, fraudulent, threatening, harassing, or abusive purpose;
2. Impersonate another person or misrepresent your identity or authority;
3. Submit another person’s private information without authorization;
4. Attempt to access restricted systems or information;
5. Introduce viruses, malware, or harmful code;
6. Interfere with Site operation or security;
7. Use automated tools in a way that places an unreasonable burden on the Site;
8. Collect provider, staff, or visitor information for unsolicited marketing or harassment;
9. Use Site content to make false or misleading claims;
10. Circumvent technical protections;
11. Probe Site security without written authorization; or
12. Help another person engage in prohibited conduct.
15. Site accuracy and availability
Trugenex seeks to maintain accurate and useful Site content but does not guarantee that every statement is complete, current, error-free, or appropriate for your individual circumstances.
Provider information, services, availability, hours, pricing, qualifications, external links, and educational content may change.
Trugenex may:
* Correct or update content;
* Remove content;
* Modify the Site;
* Temporarily suspend access;
* Permanently discontinue a feature; or
* Restrict access when reasonably necessary for security, maintenance, or legal compliance.
Trugenex is not responsible for interruptions caused by hosting failures, internet outages, cyber incidents, maintenance, third-party services, or circumstances outside its reasonable control.
16. Disclaimer of warranties
To the fullest extent permitted by law, the public Site is provided on an “as is” and “as available” basis.
Trugenex disclaims implied warranties concerning the public Site, including warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted operation, accuracy, and security.
Trugenex does not warrant that:
* The Site will always be available;
* The Site will be free from errors or harmful components;
* Every message will reach the intended recipient;
* Every inquiry will receive a response;
* Site information will be appropriate for every visitor;
* A third-party link or service will perform as expected; or
* Use of the Site will produce a particular health, wellness, financial, or other result.
This disclaimer concerns the public Site. It does not alter obligations expressly accepted by Trugenex in a separate written service agreement.
17. Limitation of liability
To the fullest extent permitted by law, Trugenex and its owners, employees, contractors, and Site service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from:
* Use of or inability to use the public Site;
* Reliance on general Site information;
* Loss, delay, or misrouting of a general inquiry;
* A third-party website or service;
* Unauthorized use of the Site by another person; or
* Site interruption or technical failure.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from fraud, willful misconduct, gross negligence, or another nonwaivable legal obligation.
Some jurisdictions do not permit certain warranty exclusions or liability limitations. In such jurisdictions, these provisions apply only to the maximum extent permitted by law.
18. Indemnification
To the extent permitted by law, you agree to reimburse and hold harmless Trugenex and its personnel from third-party claims, losses, liabilities, and reasonable expenses arising from:
* Your unlawful or intentionally harmful use of the Site;
* Your material violation of these Terms;
* Information you submit without appropriate authorization; or
* Your infringement of another person’s privacy, intellectual-property, or other legal rights.
This provision does not apply to the extent a claim results from Trugenex’s own negligence, willful misconduct, or violation of law.
19. Governing law and venue
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules.
Subject to any nonwaivable right to bring a claim elsewhere, a dispute arising specifically from use of the public Site shall be brought in a state or federal court serving the county in which Trugenex maintains its principal place of business.
Nothing in this section waives a consumer right or remedy that applicable law does not permit the parties to waive.
20. Changes to these Terms
Trugenex may update these Terms to reflect changes in the Site, services, business practices, or applicable law.
The updated version will be posted on this page with a revised “Last Updated” date. Material changes may also be announced through a prominent notice on the Site.
Changes apply prospectively from the stated effective date.
21. Miscellaneous
These Terms and any documents expressly incorporated into them constitute the agreement governing use of the public Site.
If a provision is determined to be unenforceable, it will be modified or severed only to the extent necessary, and the remaining provisions will continue in effect.
Trugenex’s failure to enforce a provision is not a waiver of its right to enforce that provision later.
You may not assign your rights under these Terms without written permission. Trugenex may assign these Terms in connection with a merger, restructuring, transfer of ownership, or transfer of Site operations.
